Update provided regarding further travel restrictions under US Visa Waiver Program

Changes were recently being implemented to the Visa Waiver Program (VWP) pursuant to the Visa Waiver Program Improvement and Terrorist Travel Prevention Act of 2015 (the Act). The Act contains categorical exclusions from the VWP for nationals of "state sponsors of terrorism" as classified by the Department of Homeland Security (DHS), including nationals of Syria, Iraq, Iran and Sudan. DHS has now added Libya, Somalia and Yemen to the list of countries of concern. While dual nationals of a VWP program and these countries may continue to travel under the VWP, anyone who has traveled to these three countries in or after March 2011 must apply for a US visa prior to such travel. There are some exceptions based on the reason for travel, and waivers may be available on a case-by-case basis for individuals who have traveled to these countries.

A Tax Alert prepared by Egan LLP, and attached below, provides additional details.
