Poland likely to postpone new tax on retailers

A previous EY Global Tax Alert reported plans to introduce a new tax on retailers in Poland as of July 1. However, this date is likely to be postponed as the Polish Parliament has not yet passed the law. Notwithstanding this delay in passage, further details on the new retail tax were recently issued. The value added tax (VAT) exclusive value of retail sales (defined as sales made to consumers) will be subject to the retail tax. Retailers (both natural and legal persons) will be required to pay the tax on the sale of goods (or parts thereof). It is unclear if the retail tax will apply to e-commerce sales and there have been reports that internet sales will be outside the scope of the tax.
