UK's monthly limit on Tier 2 General Restricted Certificates of Sponsorship exceeded for fifth consecutive month

The monthly limit on Restricted Certificates of Sponsorship (RCoS) available to sponsors of non EU nationals coming to work in the UK has been exceeded at the April 2018 monthly panel meeting for the fifth consecutive month, leading to a significant number of requests being rejected. The exact points threshold below which RCoS are being rejected has not yet been confirmed, but as of publication, requests for non-PhD, non-shortage occupation list jobs with salaries of less than £50,000 per annum have been rejected. This outcome is particularly significant since more RCoS were available this month for allocation than in previous months. This development appears to indicate that this issue may now become a routine monthly occurrence.

A Tax Alert prepared by EY's People Advisory Services group, and attached below, provides additional details.
