19 September 2019 Oregon law allows school janitors and maintenance workers to collect UI benefits during school breaks Recently enacted Oregon legislation (HB 2660, CH 407) effective January 1, 2020, allows eligible janitorial and maintenance workers employed by public and nonprofit educational institutions to collect unemployment insurance (UI) benefits during school breaks, such as summer vacations and holiday recesses. Other educational employees, such as teachers/professors, those performing research or principal administrative work, bus drivers and school nurses, etc. continue to be ineligible for UI benefits during school breaks. The law also requires state and political subdivisions to provide their employees with information supplied by the Oregon Employment Department regarding UI benefit eligibility. These employees are prohibited to inform employees that they are ineligible for UI benefits unless the Department has determined that they are in fact ineligible. Finally, a provision is added to state that if any provision of the Act or related administrative rule is determined to be out of conformity with federal law, the provision will no longer take effect.
