House Education & Labor Committee advances "Ban Surprise Billing Act"

On February 11, the House Education and Labor Committee advanced out of committee the "Ban Surprise Billing Act" (H.R. 5800) by a vote of 32-13, displaying division within the committee on the best way to settle billing disputes between providers and insurers in surprise billing situations. The bill would limit cost-sharing for Americans to their insurance plan's in-network rate and prohibit providers outside their patients' networks from billing patients more. The bill would handle payment disputes by paying providers the median in-network rate for surprise bills under $750 and allow for an arbitration mechanism for disputes over bills higher than $750. The approach is similar to a compromise reached by the House Energy and Commerce and Senate HELP Committees last December.
