BREAKING TAX NEWS | Supreme Court declines to hear Altera case concerning whether stock-based compensation costs can be included in cost-sharing arrangements

On June 22, 2020, the Supreme Court issued an order declining the petition for certiorari in Altera v. Commissioner, 926 F.3d. 1061 (2019). Altera's petition asked the Supreme Court to review the Ninth Circuit Court of Appeals decision upholding a 2003 regulation that requires participants to include stock-based compensation costs in a cost-sharing arrangement.
