IRS publishes rules requiring health plans and health insurance issuers to submit information on Rx drug and health care spending

The IRS has issued interim final regulations (TD 9958) that require group health plans and health insurance issuers to submit certain information on prescription drug and health care spending to the Departments of Treasury, Health and Human Services, and Labor. The regulations will become generally applicable on December 27, 2021, although enforcement will be limited during the first year of applicability. A notice of proposed rulemaking (REG-117575-21) invites comments on the regulations to be submitted by January 24, 2022.
