November 30, 2021 2021-2159 IRS will accept e-signatures on specified forms until October 31, 2023 The IRS has further extended from December 31, 2021, until October 31, 2023, the date through which it will accept e-signatures on specified tax forms and returns. On November 18, 2021, the IRS released an updated memo (see attached) allowing e-signatures to be used on specified non-return documents, including extensions of the statute of limitations on assessment or collection, waivers of statutory notices of deficiency and consents to assessment, closing agreements, and "any other statement or form needing the signature of a taxpayer or representative traditionally collected by IRS personnel outside of standard filing procedures." The memo does not prescribe any specific method for e-signing the specified forms. Taxpayers may therefore choose their preferred e-signature method. The memo revises similar memos issued in the past two years (see Tax Alerts 2021-1606, 2021-0825, 2020-0841, 2020-2148, 2020-2206). Also on November 18, 2021, the IRS issued a second memo (see attached) extending until October 31, 2023, the date on which it will accept e-signatures on certain forms and returns that cannot be filed electronically, and that are signed and postmarked on August 28, 2020, or later. Implications The IRS continues to acknowledge the difficulties the pandemic has created in securing handwritten signatures for forms that must be filed or maintained on paper.
