Partnership's environmental consulting activities were profit-driven, even if imperfect, Tax Court concludes

In a taxpayer-favorable decision, the Tax Court has held (Jessica Walters, et al. v. Commissioner) that a partnership formed by a mother, father and adult daughter was engaged in a for-profit green construction/consulting business through the construction and promotion of an environmentally constructed show home. The "partnership's efforts were not perfectly executed, but its actions overall fall in favor of a conclusion that it was seeking a profit," the court concluded.
