Illinois Department of Revenue automatically extends the extended due date for calendar year 2021 corporate income tax returns to November 15

On October 11, 2022, the Illinois Department of Revenue (Department) announced that it was automatically extending to November 15, 2022, from October 17, 2022, the extended due date for filing the Illinois corporate income tax return, Form IL-1120, for calendar year 2021. This extension only applies to the filing due date and does not extend the time to pay.

The Department explained that a 2016 change to the due date for the federal corporate income return has caused the federal and Illinois extended due dates to coincide. A proposed amendment to 86 Ill. Admin. Code 100.5020 would permanently restore the extended due date for filing the Illinois corporate income tax return to one month after the federal automatic extended due date. The automatic seven-month extension to file the Illinois corporate income tax return would retroactively apply to tax years ending on or after December 31, 2021.

The proposed regulation cannot be formally adopted until later this month at the earliest. The Department has provided this guidance for taxpayers wishing to take advantage of the extra time to file.
