     This week's tax news from the Americas

  • Canada substantively enacts capital cost allowance and other business income tax measures in Bill C-15
    On 26 February 2026, amended Bill C-15, Budget 2025 Implementation Act, No. 1, received third reading in the House of Commons and became substantively enacted for Canadian financial reporting purposes. The bill implements key tax measures, including the reinstatement of accelerated capital cost allowance for most capital properties and enhancements to the scientific research and experimental development program. It also repeals the digital services tax, effective 20 June 2024.
  • Colombia | Highest court for tax matters clarifies documentation requirements for intercompany services
    On 12 February 2026, Colombia's Council of State held that taxpayers making cross-border payments for intragroup services must provide sufficient and appropriate documentation proving that intragroup services were rendered and generated identifiable benefits. The ruling emphasizes that withholding tax must be applied on cross-border payments to parent companies for management and direction services; failure to withhold tax makes the expense nondeductible for income tax purposes, even when transfer pricing requirements are met.
  • Canada | Alberta Budget 2026 discussed
    On 26 February 2026, Alberta Minister of Finance and President of Treasury Board Nate Horner introduced the province's fiscal 2026 budget. The budget maintains current corporate income tax rates and personal income tax rates. It also proposes changes to the data center levy. Rather than applying to the value of computing equipment in large-scale data centers in Alberta, the levy would be based on a center’s actual power consumption. Power not drawn from Alberta’s existing power grid would be eligible for a 0% levy rate.
  • Canada | Nova Scotia Budget 2026 discussed
    On 23 February 2026, Nova Scotia Minister of Finance and Treasury Board John Lohr introduced the province's fiscal 2026 budget. The budget contains no new taxes and no income tax increases but includes a proposed increase to the financial institutions capital tax.
