   This week's tax news from the Americas

  • U.S. Customs and Border Protection announces 20 April 2026 rollout of CAPE process for Phase 1 entries to administer IEEPA duty refunds in ACE
    On 10 April 2026, U.S. Customs and Border Protection (CBP) announced via a Cargo Systems Messaging Service bulletin and webpage that its Consolidated Administration and Processing of Entries (CAPE) Portal will go live on 20 April 2026 for refunds of duties imposed under the International Emergency Economic Powers Act (IEEPA). CBP also released a website with additional information and status updates on the IEEPA refund process and the rollout of the CAPE Portal. Businesses should confirm system access within the Automated Commercial Environment (ACE) Portal, organize import summary information, arrange for electronic refunds, and closely follow CBP communications on CAPE launch milestones and filing guidance.
  • Mexico amends Article 141 provisions on guarantee of tax liabilities
    Mexico amended Article 141 of its Federal Tax Code to eliminate the mandatory order of priority that taxpayers had to follow when providing documents to guarantee tax liabilities when challenging a tax assessment. It also removed the requirement to provide evidence of economic capacity to access certain types of guarantees. The changes were published on 9 April 2026 and took effect 10 April 2026. A transitional regime is available for taxpayers that provided guarantees in 2026 before the amendment was enacted and published.
