| | This week's tax news from the Americas - Colombia's Constitutional Court announces unconstitutionality of tax measures adopted under the 2025 economic emergency
On 15 April 2026, Colombia's Constitutional Court announced that Decree 1474 of 29 December 2025, which introduced temporary tax measures under the 2025 economic emergency, was unconstitutional following the invalidation of the emergency powers in Decree 1390. The court held that direct taxes modified or accrued during the decree's effective period (30 December 2025 to 28 January 2026) will not be subject to filing, assessment or collection, and any advance payments will be refunded. Indirect taxes paid during this period may also be refunded to taxpayers that can prove they bore the tax burden, with the tax authority expected to establish refund procedures.
- Canada temporarily suspends federal excise tax on fuel
On 14 April 2026, the Canadian government announced it will temporarily suspend the fuel excise tax on gasoline, diesel and aviation fuel levied under Part III of the Excise Tax Act . This measure will apply to gasoline, unleaded aviation gasoline, diesel fuel and aviation fuel for which the tax becomes payable after 19 April 2026 and before 8 September 2026. The federal government indicated this measure is intended to provide relief from rising fuel prices resulting from recent global oil disruptions. On the same day, the federal government announced it will introduce its spring economic update on 28 April 2026.
